Verdict just in: Marie Ann Gum v. The Cato Corporation

This was a slip and fall bench trial before Judge Eichwald in Sandoval County. Plaintiff slipped and fell on top of a caution sign after completing her purchases at a Cato Fashion Store after a previous, unidentified customer dropped a glass bottle of perfume at the cash register. The Cato Store employees testified that they had wiped the area down with Windex. Less than $2,000.00 offered at Mediation with Judge Hall, on the grounds of comparative fault, which was not raised as an issue at trial.

Rule 68 Offer of settlement rejected, but almost twice the offer was awarded by Judge.
