Verdict just in: Wrongful Death Estate of Vickie Edwards and Mike Edwards v. Nor-Lea Hospital District teleseminar

Vickie Edwards was a life time smoker in her 50s whose primary care physician ordered a routine chest x-ray in March of 2015. Vickie went to Nor-Lea Hospital to get the x-ray taken. Nor-Lea contracted out its radiology services to an out of state teleradiology provider who interpreted the x-ray determining Vickie had a 1.3 cm mass in her lung but did not call the ordering physician nor Nor-Lea. Instead, he faxed the report to Nor-Lea’s radiology department, ER department, and then placed the report in Nor-Lea’s electronic medical record.

 The ordering physician never received the report and 18 months passed. By the time the ordering physician obtains a copy of the report (18 months later) Vickie’s lung mass is 6 cm and the cancer has spread. By this point, it is too late to save Vickie and she subsequently passes away due to her cancer.

 We originally filed suit in Santa Fe against Nor-Lea, the primary care physician, and the radiologist, but had to dismiss Nor-Lea and re-file those claims in Lea County because Nor-Lea is a local public body under the Tort Claims Act. The Santa Fe lawsuit completely resolved leaving the remaining claim against Nor-Lea hospital.

This trial had significant empty chairs and other hurdles. Ultimately, we were able to present our case against the hospital and obtain a great result for our client.
