Verdict just in: Wrongful Death Estate of Kathryn Armijo v. Werner Enterprises, Inc. teleseminar

Tuesday, November 5, 2019
2:00 p.m. - 3:00 p.m.
1.0 CLE Credit

The case involved a trucking accident in which 54-year old Kathryn Armijo was killed on I-10 near Las Cruces when a Werner tractor trailer crossed over the two east bound lanes, the median, and the two west-bound lanes, hitting Kathryn as she tried to avoid the collision by moving into the shoulder. It was the driver's 8th day on the job; he had just graduated from Werner's truck driving school (Roadmaster) with poor grades and placed with a "trainer" at Werner who was supposed to show him the ropes. Instead, the trainer slept in the sleeper berth most of the time that the new driver was driving during his first week. Evidence showed cruise control was on and the driver didn't break until 0.5 seconds before impact.

At the end of a two-week trial, the jury awarded $30.5m in compensatory damages and $10m in punitives.
