A 39 year-old mother of three was driving on I-40, with her husband in the front passenger seat and her two daughters in the back seat, when they wer hit from behind. The defendant was driving at 75 mph, per her testimony, when she looked down to change the radio. When she looked back up, she saw brake lights. She estimates still going 35-40 mph when she crashed into the rear of plaintiffs' car sending that car into the vehicle in front of her, causing airbags to deploy. Both, plaintiff and defendant, vehicles were totaled.

Defense NEVER admitted liability and employed the 'fraud defense.'
